Who pays the estate agent’s commission in Italy, and when?

By law both parties owe the agent’s commission, unless they agree otherwise, when the deal closes through the agent’s work (Civil Code art. 1755). The rate is negotiated, typically 3% to 5% of the price, plus VAT. The right to the fee arises with the preliminary contract (compromesso), or already with an accepted offer if it contains the essential terms. Trevi Elite’s own terms are provided on request, before any mandate is signed. Our step-by-step guide to buying property in Rome shows where each payment falls.
